Analysis on Supreme Court DOMA Ruling
An example of the research content produced by CCH is a recent tax briefing examining the impact of last week’s Supreme Court striking down the Defense of Marriage Act.

CCH issued a new Tax Briefing: Supreme Court Strikes Down DOMA, providing expert analysis and insights on key tax provisions affected by the Supreme Court’s historic ruling.

In a decision that will generate significant change in U.S. tax law, the court struck down DOMA in a 5-4 ruling on June 26, saying it was unconstitutional in denying benefits and equal protection under the law to same-sex married couples (see DOMA Deciphered: What the Decision Means). The decision opens the door for same-sex married couples to enjoy many federal tax-related benefits previously available only to married couples of the opposite sex.

Specifically, the court ruled that Section 3 of DOMA violated the equal protection clause of the Fifth Amendment of the Constitution as it applies to same-sex couples legally married under the laws of their state. This decision also means employers must now prepare for extensive changes in benefits for same-sex couples and that affected couples may consider updating their estate plans based upon the estate and gift tax impact, CCH noted.

Even though the decision will immediately extend many benefits to couples in states where same-sex marriage is legal, questions remain over whether the same federal benefits will be available to those in states that do not recognize marriage of same-sex couples.

“The court’s ruling also creates uncertainty for domestic partnerships and civil unions under state laws when it comes to federal tax benefits,” said CCH principal federal tax analyst Mark Luscombe. “Same-sex couples who were married under state law before 2013 should determine whether they may benefit from amending prior-year tax returns still open under the Tax Code’s statute of limitations and change their filing status from unmarried to married. But they are also subject to the same tax law circumstances that create what’s commonly known as the ‘marriage penalty’.”

CCH KnowledgeConnect Mobile Access
Separately, CCH said last week that it was expanding mobile access in its CCH KnowledgeConnect knowledge management system. The software now offers enhanced mobile access on Apple iPhone and Android devices as well as improved navigation for easier mobile access to important answers on the go.

“Our customers have told us they really enjoy the flexibility of having key information with them wherever they are,” CCH product marketing manager Wendy Grice said in a statement.

“KnowledgeConnect is well suited for serving the mobile workforce with enhancements to enable users to quickly pinpoint content as well as conveniently and securely share details.”

Through its new mobile site, the enhanced KnowledgeConnect solution can now detect when it is being accessed by an iPhone or Android device and will automatically deliver content in a colorful mobile format display.

Other new enhancements include a client view feature that enables firms to securely provide KnowledgeConnect access to clients and select specific content to be seen. Users can now identify their favorite items and save popular content to access it more easily. Specific articles, searches and contacts can be organized as favorite items for repeat reference.

KnowledgeConnect also now offers a way for users to write and store information in the form of a Wiki. Users can add notes, summaries and thoughts for colleagues and clients to call up and comment on. In addition, the enhanced system can extend permissions for who can edit or delete articles within KnowledgeConnect as well as enable users to sort results by a variety of parameters.
